5. Notice and action mechanism under Article 16 DSA

Notices concerning specific illegal content may be sent to info@stickermap.de with the subject “DSA notice”. To enable us to assess the notice diligently, it should contain:

  • a precise identification of the content concerned, in particular its link or report ID,
  • a substantiated explanation of why the content is considered illegal,
  • the name and email address of the notifying person or entity, and
  • a statement confirming the good-faith belief that the information provided is accurate and complete.

We acknowledge receipt without undue delay. Notices are processed in a timely, diligent, objective and non-arbitrary manner. We then notify the reporting person without undue delay of our decision and the available means of redress.

For ordinary corrections concerning an inaccurate location, duplicate report or inaccurate description, the “Report content” function on the relevant report remains available. This general correction mechanism does not replace the procedure above for notices concerning illegal content.

6. Liability for user content

Reports are submitted by users and constitute information provided by them. Article 6 DSA applies to such stored information. StickerMap is not required to monitor all stored content generally or actively seek facts or circumstances indicating illegal activity (Article 8 DSA).

No guarantee is given for the accuracy of reported locations or descriptions. When we obtain specific knowledge of illegal content, we remove or disable access to it expeditiously.

7. Hosting

This website is operated on a server administered by us and hosted by STRATO GmbH, Otto-Ostrowski-Straße 7, 10249 Berlin, Germany. The server is located in Germany. No content delivery network is used. Further information is available in the privacy policy.

8. Liability for links

External links are checked for apparent legal infringements when they are added. We have no control over subsequent changes to linked content. Continuous monitoring is not reasonable without specific indications of an infringement. If we become aware of an infringement, we remove the relevant link expeditiously.

9. Terms of use and moderation rules

StickerMap is intended solely for the clearly oppositional documentation of hateful, anti-constitutional and far-right symbols in public spaces. Submitted material must document an actual find and must not misuse the purpose of the platform.

Prohibited material includes content that

  • is manifestly fabricated, misleading or submitted abusively,
  • identifies or names individuals or contains other personal data such as private addresses or vehicle registration numbers,
  • endorses or promotes hateful, anti-constitutional or far-right ideologies instead of documenting them in a clearly oppositional context,
  • is unlawful or infringes copyright, personality rights or other third-party rights, or
  • has no reasonable connection to StickerMap's purpose.

Technical checks cover required fields, coordinates, file types, file sizes and repeated requests, among other matters. They may hold unusual or geographically clustered submissions for review. Reports may also be reviewed by a person. There is no general legal pre-screening of all user content.

Depending on the nature and severity of a violation, content may be held, corrected, restricted in visibility, marked invalid or removed. Anonymous sessions used abusively may also be blocked from further submissions. Decisions are taken diligently, objectively and proportionately, with due regard for the rights and legitimate interests of all parties.

If we know the affected submitter's electronic contact details, we inform them no later than when content is removed or restricted. The notice sets out the relevant facts and circumstances, the legal or rules-based ground, where applicable information on automated means, and the available means of redress (Article 17 DSA).

10. Legal notice – Display of anti-constitutional symbols

Where images contain symbols within the meaning of section 86a of the German Criminal Code, they are published solely in a clearly oppositional context of documentation and civic education. StickerMap does not make the depicted material available in an approving or promotional manner and expressly rejects the underlying ideologies.

Section 86a(3) of the German Criminal Code incorporates the exceptions in section 86(4), including civic education, countering anti-constitutional activities and reporting on current events. In its judgment of 15 March 2007 – 3 StR 486/06 – the Federal Court of Justice also held that the offence is not made out where the context of the depiction makes opposition to the organisation and the fight against its ideology obvious and unambiguous.

The operator considers StickerMap's display to serve these permitted documentation and educational purposes. The specific context in which each item is displayed remains decisive.

StickerMap is a non-commercial project. The source code is not publicly licensed – please get in touch if you are interested in collaborating.
